Terms of Service

These Terms are an agreement between you and Atom Fusion LLC, an Ohio limited liability company doing business as Get Fit Protocol ("we," "us"). They cover your use of getfitprotocol.com, our mobile app, and our coaching services (the "Service"). By creating an account or buying a membership, you agree to these Terms, our Privacy Policy and our Refund Policy.
Important: Get Fit Protocol provides fitness and nutrition coaching, not medical care. Talk to your doctor before starting any exercise or nutrition program, especially if you have a medical condition, are pregnant, or take medication.
1. Eligibility
You must be at least 18 years old and able to enter a binding contract. You're responsible for keeping your login secure and for activity on your account.
2. Not medical advice
Our plans, the Virtual Trainer, real-time feedback, dashboard widgets and trainer sessions are for general fitness and educational purposes. They are not medical advice, diagnosis or treatment, and they don't replace care from a doctor, registered dietitian or other licensed professional. Content about health topics such as blood sugar or blood pressure is educational only. Follow your healthcare provider's guidance on your treatment, targets and medications. If you have chest pain, fainting, shortness of breath or any other concerning symptom, stop exercising and seek medical help.
3. Assumption of risk
Exercise carries a risk of injury. You choose how and when to follow any plan, and you agree to use proper form, appropriate weights and safe equipment, and to stop if something feels wrong. To the extent the law allows, you take on the risks of the physical activity you choose to do.
4. Memberships, billing and auto-renewal
- Plans: Base ($60/month or $600/year) and Advanced ($99/month or $990/year), in US dollars, plus any applicable tax. What each plan includes is described on our pricing page.
- Auto-renewal: your membership renews automatically at the end of each month or year, and we charge your payment method on file until you cancel. We'll remind you before an annual renewal.
- Cancelling: cancel anytime from "Manage billing" in your account. Your access continues until the end of the current billing period. Refunds follow our Refund Policy.
- Failed payments: if a payment fails, we'll retry it and let you know. We may pause access until the payment goes through.
- Price changes: we'll give you at least 30 days' notice before a price change applies to your membership, and you can cancel before it takes effect.
- Promotions: discount codes such as FOUNDER25 apply only as described when offered, and can't be combined unless we say so.
- Payments are processed by Stripe. Charges appear as GETFITPROTOCOL.
5. Trainer consults and check-ins
Memberships include video sessions with trainers as described for your plan. Sessions are scheduled through your dashboard and take place over video (for example Zoom). Please reschedule at least 24 hours ahead. Missed sessions may not be made up. Trainers are independent contractors who provide coaching under these Terms. Sessions may be recorded only with everyone's consent.
6. The Virtual Trainer and AI features
Some features, including your weekly plans and the Virtual Trainer, are generated with artificial intelligence. AI can make mistakes. Use your judgment, and ask your trainer or a medical professional if something doesn't seem right for you. The Virtual Trainer is not a human, though it can pass questions to a real trainer.
7. Your content and conduct
You keep ownership of what you log and upload. You give us permission to use it to provide and improve the Service, as described in our Privacy Policy. You agree not to misuse the Service, share your account, harass trainers or other members, upload unlawful content, or try to copy, reverse-engineer or disrupt the Service.
8. Our content
The Service, including our plans, programs, text, graphics, videos and software, is owned by us or our licensors. Your membership gives you a personal, non-transferable right to use it for your own fitness while your membership is active. You may not resell or redistribute it.
9. Changes to the Service
We may update or change features over time. If we make a material change that reduces what your plan includes, we'll tell you in advance, and you can cancel.
10. Suspension and termination
We may suspend or end accounts that violate these Terms or put others at risk. You can close your account at any time.
11. Disclaimers
The Service is provided "as is." We don't guarantee specific results, such as a certain amount of weight loss or strength gain, because results depend on many factors, including your effort, health and consistency. To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Limitation of liability
To the extent the law allows, Atom Fusion LLC and its owners, trainers and contractors won't be liable for indirect, incidental, special or consequential damages. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.
13. Governing law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Cuyahoga County, Ohio, unless the law requires otherwise. Before filing any claim, please contact us so we can try to resolve it informally.
14. Changes to these Terms
We may update these Terms. If a change is material, we'll notify you by email or in the app before it takes effect. Continuing to use the Service after that means you accept the updated Terms.
